Maxine Waters Violates US Constitution and US Code 18

Representative Maxine Waters (D-CA, 43rd District) spoke on June 23rd at a Los Angeles rally and encouraged her supporters to harass official members of the Trump cabinet. She urged her followers to “turn on them, to protest, and to absolutely harass them.” In addition, she directed people to ensure that Trump Administration officials are unable to peacefully appear in public without being harassed.

“If you see anybody from that Cabinet in a restaurant, in a department store, at a gasoline station, you get out and you create a crowd and you push back on them, and you tell them they are not welcome anymore, anywhere.” 

Waters was insistent that the harassment should continue until the Cabinet members resign.

Rep Waters has incited rebellion, encouraged sedition by directing her supporters to force Cabinet members to resign (thereby interfering with the US Government’s ability to function), and promoted the overthrow of the US Government. Rep Waters has violated US Code 18, Chapter 115 and the 14th Amendment of the US Constitution. The House of Representatives should immediately use Article 1, Section 5 of the US Constitution to remove Maxine Waters from her position.

US Code, Chapter 115 is very clear about inciting rebellion, insurrection, or attempting to overthrow the US Government. Maxine Waters has incited rebellion and is encouraging people to put down official authoritative members of the US Cabinet.

  • Subchapter 2383 discusses rebellion or insurrection against the authority of the US or the laws thereof.
  • Subchapter 2384 discusses seditious conspiracy to overthrow, put down, or to destroy by force the Government of the US or to oppose by force the authority thereof.

  • Subchapter 2385 discusses the attempt of any person to organize any society, group of assembly of persons who teach, advocate, or encourage the overthrow or destruction of any such government by force or violence.

Representative Waters has violated all three Subchapters.

US Constitution, Article 1, Section 5

The United States was founded on the basic principle that all its citizens are created equal and ALL are entitled to life, liberty, and to the pursuit of happiness. It also states the rules and governing principles of Congress, including both the House and the Senate.

Under the US Constitution, Article 1, Section 5, each House of Congress may determine the Rules of its proceedings, punish its members for disorderly behavior, and, with the concurrence of two-thirds, expel a member.

Maxine Waters can be removed under this section.

We have many important amendments to ensure our culture of freedom, among them the guarantee of privileges and immunities of citizenship, due process, and equal protection (14th Amendment).

The 14th Amendment includes paragraph 3, which states the following:
3: No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.

Maxine Waters has engaged in insurrection and incited rebellion with her hateful words and divisive rhetoric.  It is incomprehensible that an elected official and a member of the House of Representatives is promoting hostility, violence, and rebellion. And, it is all based on the fact that she doesn’t like the President of the United States.

For the past 15 months, Maxine Waters has screamed “Impeach 45!” Now we are expected to believe that she is promoting civil unrest and rebellion for the benefit of families. So, she wants to harass cabinet members to the point that they resign, effectively bringing the US Government to a halt. And, that will help keep families together…how??

Never mind that President Trump signed an emergency Executive Order to keep illegal immigrant families together at the border. Congress refused to act by creating a new immigration law (which is the job of Congress). The Executive Order was to remedy the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 that President Clinton signed Sep 30, 1996. This law has been enforced by Presidents Bush and Obama, and was signed by Senator Dianne Feinstein (CA), Senator John McCain (AZ), and Representative Adam Schiff (D-CA, 28th District).

Representative Waters is using her power of public office to encourage and incite public harassment and to promote ostracization of a group of people based on their public office.  She is further urging people to stalk US Cabinet members and to so harass them that they quit. This is a tool of rebellion against the United States in order to disrupt the functioning of the US Government.

In my opinion, Maxine Waters, Representative for the State of California, has violated US Code 18, Chapter 115, Subchapters 2383, 2384, and 2385. Rep Waters has also violated paragraph 3 of the 14th amendment by participating in and inciting rebellion against the United States. Using the power of her public position, she has encouraged violence and public harassment against Public Officials, promoted stalking, and urged repression.

It is time to enforce the US Constitution. The House of Representatives must remove Maxine Waters from her position as a representative by using Article 1, Section 5, based on her violations of US Code 18, Chapter 115 and Amendment 14, paragraph 3.
